Don’t the Trumps have enough to do in Washington or are states rights next to go? Hold on folks.
I hate to disagree with the Trump family but on this one but I’ve got to get in the McMaster /Massey Camp when it comes to protecting citizens and small businesses in SC. Everyone seems concerned their favorite restaurant or bar is closing down because they can’t afford the high insurance premiums. Then we all want to sit back and blame the insurance company for raising rates. That all sounds logical right. It’s not logical at all. I’m going to break this down for you in laymen’s terms.
It’s Friday night. Just any old Friday night but you and your friends are feeling good. You are all ready to go out and have a long relaxing weekend. You plan to meet at a local bar to make plans and you all have one beer there. Plans made and you head downtown to another upscale bar that serves you two liquor drinks when you decide to walk across the street to a nice restaurant for dinner. You all have another cocktail and then wine with dinner. Several of you have another after dinner drink. You had a big meal so you think you are all sober enough to drive to yet another bar where you proceed to have enough alcohol that you and the bartender know you are over the limit but you get one more for good measure and get in your car to drive home.
On the way home you run a red light and hit a car with a family of four inside coming home from a ballgame, killing the Mom and an 8 year old . Is the guy at the local bar who served you one beer guilty or maybe the guy that knew you were drunk but didn’t try to stop you. Should every one be liable for this loss and pay millions and millions of dollars. Each insurance company has to pay out. That’s why it’s effecting rates for this type business. That’s the way the law is now and this is why it needs to change.
Do trial lawyers want to change this? No, why would they, most receive upwards of 40% of the settlement unless they are like the Murdaugh firm and take it all.
This same scenario happens to trucking companies and small businesses.
If you want small businesses to prosper and stay in business you have to stop the payouts on these large lawsuits and the option to be able to stack coverages from parties who really have no guilt.
I will be curious to see how this pans out in the legislature next because some of the candidates that took out honest incumbents made promises to both sides for big donations. You will have to vote one way or another and your real allegiance will come out. I will be watching this closely. You should too.
